The Punjab Real Estate Regulatory Authority has passed a significant order against Omaxe Chandigarh Extension Developers Pvt Ltd for delaying possession in its New Chandigarh project. Chandigarh, March 16, 2026: Providing relief to homebuyers troubled by delays in real estate projects, the Punjab Real Estate Regulatory Authority has passed an important order against Omaxe Chandigarh Extension Developers Pvt Ltd .

Complaint Details

RERA member Binod Kumar Singh passed this order on the complaint of Chandigarh residents Bharat Singh Bisht and Geeta Bisht. The complainants alleged that they had booked a flat in the Omaxe project located in New Chandigarh and paid approximately ₹27.60 lakh, but actual legal possession was not given to them within the stipulated time .

The complaint stated that the builder caused unreasonable delay in handing over possession of the flat, causing financial and mental distress to the buyers. Additionally, the builder also charged extra amount based on super area instead of the carpet area of the flat .

According to the buyers, they were shown a super area of 1477 square feet instead of the actual carpet area of 974 square feet, and approximately ₹18.69 lakh was illegally charged extra .

Arguments Presented

During the hearing of the case, the complainants' lawyer M Shahnawaz Khan argued that under RERA law, it is mandatory for the builder to complete the project and hand over possession within the stipulated time. If there is a delay, there is a provision to pay interest on the deposited amount to the buyers .

He further argued that the price should be determined based on carpet area, while the builder violated rules by charging extra money in the name of super area. On the other hand, the builder company denied the allegations .

RERA Order

In its order, RERA stated that the delay in the project is clearly evident and the buyers were not given possession within the stipulated time. Therefore, the builder is directed to pay interest to the complainants on the deposited amount according to RERA rules, which will continue until actual legal possession is given .

Additionally, the authority also stated that the additional amount taken based on super area instead of carpet area is not in accordance with rules. Therefore, the builder will have to refund the approximately ₹18.69 lakh extra amount collected from the buyers .
