Haryana RERA Orders Imperia Structures to Pay ₹55 Lakh Compensation to Gurugram Homebuyers

Gurugram, March 24: The Haryana Real Estate Regulatory Authority (Haryana RERA), Gurugram, has directed Imperia Structures to pay ₹55 lakh as compensation to homebuyers for loss of property appreciation in the delayed 'The Esfera' project in Sector 37C.
The order was passed in a case filed by Harjeet Kaur Dhillon and HS Dhillon, who had booked an apartment in November 2013. Possession was promised within 42 months, by May 2017, but the project was delayed.
In addition to the ₹55 lakh compensation for loss of appreciation, the adjudicating officer directed the builder to pay ₹1 lakh for mental agony and harassment, along with ₹50,000 towards litigation expenses.
The complainants had previously approached RERA in 2019 seeking a refund. In November 2022, the authority ordered the developer to refund ₹73.37 lakh paid by the complainants, along with applicable interest. The buyers later filed a separate plea in 2023 seeking compensation for loss of appreciation and other damages.
The adjudicating officer noted that the complainants had paid nearly 95% of the total sale consideration—₹73.37 lakh out of ₹78.15 lakh—by June 2017, but possession was not delivered within the stipulated timeline. The authority observed that the delay had adversely impacted the buyers, who had invested a significant portion of their savings in the project.
