Prayagraj, April 18: A division bench comprising Justice Mahesh Chandra Tripathi and Justice Vivek Varma passed the order while fixing April 29 as the next date of hearing, asking the state government to file its counter affidavit within a week.

Background

An urgent mention was made before the Chief Justice on April 15 citing the imminent demolition of 48 residential and commercial establishments in Nahar Bazar area scheduled for 6 am on April 16. Following this, the bench was constituted through an administrative order on the same day.

Petition Details

The writ petition challenges the validity of an order dated September 30, 2025 , seeking directions to restrain authorities from evicting and dispossessing the petitioners from the land.

Arguments

Petitioners' Counsel: Despite submission of relevant documents, these were not considered while passing the impugned order. Any demolition would cause irreparable loss.

State Counsel: Adequate opportunities had been provided to the petitioners, but they failed to appear during proceedings, leaving authorities with no option but to proceed as per law.
