The district consumer commission has held Supertech Limited guilty of deficiency in service after a flat sold by the builder in Ecovillage-2 developed seepage and sewage problems, ordering the company to rectify the defects within 30 days.

Noida, April 18: The commission also ordered the builder to pay the owner ₹4,000 towards mental anguish and litigation costs.

Case Details

  • Complainant: Minimol Chanchal Singh

  • Location: Tower C-3, Ecovillage-2, Sector 16B, Greater Noida

  • Flat allotment: September 2016 (₹27 lakh, inclusive of registry charges)

  • Problem: Dirty sewer water and dampness from September 30, 2016

  • Monthly maintenance: ₹3,223 (allegedly failed to address problem)

Complainant's Allegations

  • Builder failed to take remedial action despite repeated requests

  • Maintenance agency promised pipeline disconnection but never carried it out

  • Failed to install a sewage treatment plant

  • Flats were sold before construction was complete

Builder's Defence

  • Flat allotted to complainant's husband who took possession to his full satisfaction

  • Lease deed executed

  • Maintenance governed by separate agreement with maintenance agency

Commission's Ruling

The commission rejected the builder's argument, noting that:

  • Supertech itself had arranged the maintenance agreement

  • Supertech Estates Pvt Ltd functioned as the maintenance agency

  • Deficiencies became apparent after three years of living – does not absolve builder of responsibility

Order

Supertech Limited, through its chairman and managing director, was directed to resolve the grievances within 30 days.
