Bombay High Court Orders Demolition of 16-Storey Ulhasnagar Building Over Fraudulent Approvals

Mumbai, May 1, 2026: The Bombay High Court has upheld the demolition of a 16-storey building “Jhalak Paradise” in Ulhasnagar, citing fraudulent permissions and major planning violations.
Court Slams Builder and Officials
The court observed that the developer misled authorities and obtained approvals through misrepresentation, while also criticizing civic officials for failing to properly verify documents.
Approvals Declared ‘Null and Void’
The bench ruled that:
• Permissions were obtained fraudulently
• The structure is completely illegal
• No relief can be granted to parties approaching with “unclean hands”
Major Encroachment Violations
Investigations revealed:
• Around 80% of the building encroached on DP roads
• Construction was done over 24m and 36m development plan roads
• Only 3m margin was left vs required 9.7m
This clearly indicated deliberate violations despite awareness of planning restrictions.
No Relief, Immediate Demolition
The court rejected the developer’s request for a stay and directed authorities to proceed with demolition as per law.
