UP RERA: Buyers in Unregistered Projects Can Now File Complaints Against Promoters

Lucknow, April 14: If a promoter has violated rules by not registering a project, they face a penalty of 10 per cent of the project cost and up to three years of imprisonment.
New Complaint Process
Previously, only buyers of registered projects could file online complaints, leaving victims of unregistered schemes helpless. The authority issued a detailed order on April 10, now available on its website.
Information Required for Complaint
Buyers must provide detailed information about the promoter and project, including:

Promoter's contact details and address

Project location

Land documents and maps

Current construction status

Review Process
Upon receiving a complaint, the RERA bench will first verify whether the project falls under the mandatory registration requirement. If registration was compulsory and the promoter deliberately avoided it, it will be considered a serious violation of the law.
The bench will then refer the matter to the Secretary for directing the promoter to register immediately.

Sanjay Bhoosreddy, Chairman of UP RERA, said: "The objective of RERA is to protect buyers' rights and bring transparency in the real estate sector. These provisions will be further strengthened in the future."
Impact
This new system sends a strong message to defaulting promoters who tried to stay outside RERA's purview by not registering their projects. Promoters can no longer violate buyers' rights by hiding behind unregistered projects.
