Haridwar, April 29, 2026: The District Consumer Disputes Redressal Commission has directed ACE Housing Development Private Limited and its directors to refund money to a homebuyer after failing to deliver a flat within the promised timeline.

Case Background

The complaint was filed by a Ghaziabad resident who had booked a flat in the “ACE Anandika Heights” project in 2013. The buyer claimed to have paid ₹6.23 lakh, but the construction was not completed even after the promised possession deadline of 2017.

The developer, however, argued that only ₹4.04 lakh had been paid.

Commission’s Findings

After reviewing evidence, the commission found that payment receipts had been issued by authorised representatives of the company, confirming the higher amount paid by the buyer.

The panel observed that the company had failed to deliver the flat and attempted to mislead the consumer regarding the payment details.

Compensation and Refund Order

The commission has ordered the developer to:

• Refund ₹6.23 lakh to the buyer
• Pay 7% annual simple interest on the amount
• Compensate ₹1 lakh for mental harassment and financial distress
• Pay ₹25,000 towards litigation costs

The entire payment must be made within 45 days.

Consumer Protection Reinforced

The ruling highlights the accountability of developers in delayed housing projects and reinforces consumer rights in real estate transactions.

It also sends a strong message against misleading practices and non-delivery of promised properties.
