Himachal to Reintroduce Apartment Act on Punjab Model Alongside RERA

Shimla, April 27: After RERA was implemented in Himachal Pradesh, the Apartment Act was earlier abolished. Recent cases related to the Chester Hill project have highlighted the need for serious consideration of this issue.
Key Provisions
-
Mandatory registration for promoters – investors from other states will also need to register
-
Regulates multi-storey buildings and flat transactions
-
Determines ownership rights, common facilities, and management rules
-
Outside investors can only invest if registered under the Apartment Act
Why Needed?
After RERA was implemented in 2017, the Apartment Act was abolished. In recent projects, outsiders have invested by taking land in the name of Himachalis, raising questions about transparency due to lack of regulation.
Learning from Punjab Model
Following the Punjab model, Himachal plans to implement both RERA and the Apartment Act together. The Town and Country Planning Department will be given more powers for strict monitoring of projects.
Minister's Statement
Rajesh Dharmani, Minister for Town and Country Planning, said: "The Chester Hill case has highlighted the need to implement the Apartment Act alongside RERA on the Punjab model. Consideration is being given to registering investors from other states in apartments and empowering the Director of Town and Country Planning."
